When paternalism is deemed morally justified, weak paternalism—which restricts itself to assisting the target of paternalism realize his own preferences—is the preferred (less problematic) alternative. In determining the appropriateness of weak paternalism, the level of certitude of the paternalist regarding the correctness of her assessment of the true preferences of the one‐paternalized is obviously a crucial factor. Yet in the ethics of paternalism this parameter has escaped systematic treatment. This paper aims to initiate discussion on this indispensable consideration for weak (...) paternalism. Analysing a real‐life dilemma of paternalism in healthcare, the paper focuses on the theoretical question of how the paternalist can optimize her certitude by combining personal knowledge of the individual patient with population data on treatment refusal/consent of patients facing similar decisions. This work analyzes the treatment of biblical metaphor in a Jewish exegetical tradition originating in Muslim Spain that was transplanted to Christian Provence, yielding a variety of approaches that integrate Arabic poetics, hermeneutics and logic with indigenous Hebrew modes of reading.

This paper examines Hermann Cohen's idiosyncratic construction of a medieval Jewish philosophical tradition, focusing primarily, though not exclusively, on his Charakteristik der Ethik Maimunis . This construction, not unlike modern accounts, is filtered through the central place of Maimonides. For Cohen, however, Maimonides' centrality is defined not by his systematization of Aristotelianism, but by his elevation of ethics over metaphysics. The ethical and pantheistic concerns of Maimonides' precursors, according to this reading, anticipate his uniqueness. Whereas Shlomo ibn Gabirol's (...) pantheistic doctrine of emanation, for example, assigned little weight to ethics, Abraham ibn Daud rebelled against such a doctrine. Ibn Daud—much like Bahya ibn Paquda and Abraham ibn Ezra—becomes part of a Jewish philosophical tradition that culminates in Maimonides' rejection of Aristotelian metaphysics. In particular, this paper examines the way in which Cohen envisaged the pre-Maimonidean philosophical tradition, putting his highly critical reading of Shlomo ibn Gabirol and his pantheistic obsession with prime matter in counterpoint with his more favorable readings of Abraham ibn Daud and Bahya ibn Paquda. Fictional realists maintain that fictional characters are part of the world’s ontology. In an influential article, Anthony Everett argues that the fictional realist is thereby committing herself to problematic entities. Among these are entities that are indeterminately identical. Recently, Ross Cameron and Richard Woodward have answered Everett’s worry using the same strategy. They argue that the fictional realist can bypass the problematic identities by contending that they are merely semantically indeterminate. This paper concisely surveys Everett’s original argument, Cameron’s and Woodward’s (...) responses, and then argues that the strategy employed by Cameron and Woodward fails to satisfactorily answer Everett’s worries. The responsibilities of Internet Service Providers and Web-Hosting Services are in the fore, arguing that as they are the gatekeepers, they need to be proactive far more than they are now. Our knowledge about the world is often expressed by generic sentences, yet their meanings are far from clear. This book provides answers to central problems concerning generics: what do they mean? Which factors affect their interpretation? How can one reason with generics? Cohen proposes that the meanings of generics are probability judgments, and shows how this view accounts for many of their puzzling properties, including lawlikeness. Generics are evaluated with respect to alternatives. Cohen argues that alternatives are induced (...) by the kind as well as by the predicated property, and thus provides a uniform account of the varied interpretations of generics. He studies the formal properties of alternatives and provides a compositional account of their derivation by focus and presupposition. Two new philosophical problems surrounding the gradation of certainty began to emerge in the 17th century and are still very much alive today. One is concerned with the evaluation of inductive reasoning, whether in science, jurisprudence, or elsewhere; the other with the interpretation of the mathematical calculus of change. However, such experiments raise significant ethical concerns about mixing human and nonhuman materials in ways that could result in the development of human-nonhuman chimeras. This paper examines four arguments against such research, the moral taboo, species integrity, "unnaturalness," and human dignity arguments, and finds the last plausible. It argues that the transfer of human (...) brain or retinal stem cells to nonhuman embryos would not result in the development of human-nonhuman chimeras that denigrate human dignity, provided such stem cells are dissociated. Libertarian paternalism's notion of “nudging” refers to steering individual decision making so as to make choosers better off without breaching their free choice. If successful, this may offer an ideal synthesis between the duty to respect patient autonomy and that of beneficence, which at times favors paternalistic influence. A growing body of literature attempts to assess the merits of nudging in health care. However, this literature deals almost exclusively with health policy, while the question of the potential benefit of nudging (...) for the practice of informed consent has escaped systematic analysis. This article focuses on this question. While it concedes that nudging could amount to improper exploitation of cognitive weaknesses, it defends the practice of nudging in a wide range of other conditions. The conclusion is that, when ethically legitimate, nudging offers an important new paradigm for informed consent, with a special potential to overcome the classical dilemma between paternalistic beneficence and respect for autonomy. Here, we consider examples of artefacts from many fields of science (for example, astronomy, economics, electrophysiology, psychology, and systems neuroscience) and discuss their contribution to a more general evidential selection problem at the heart of the epistemology of evidence. Molyneux's Question (MQ) concerns whether a newly sighted man would recognize/distinguish a sphere and a cube by vision, assuming he could previously do this by touch. We argue that (MQ) splits into questions about (a) shared representations of space in different perceptual systems, and about (b) shared ways of constructing higher dimensional spatiotemporal features from information about lower dimensional ones, most of the technical difficulty centring on (b). So understood, MQ resists any monolithic answer: everything depends on the constraints faced (...) by particular perceptual systems in extracting features of higher dimensionality from those of lower. Each individual question of this type is empirical and must be investigated separately. We present several variations on MQ based on different levels of dimensional integration—some of these are familiar, some novel adaptations of problems known elsewhere, and some completely novel. Organizing these cases in this way is useful because it unifies a set of disparate questions about intermodal transfer that have held philosophical and psychological interest, suggests a new range of questions of the same type, sheds light on similarities and differences between members of the family, and allows us to formulate a much-augmented set of principles and questions concerning the intermodal transfer of spatiotemporal organization. The reputation and influence of Emmanuel Levinas has grown powerfully. Well known in France in his lifetime, he has since his death become widely regarded as a major European moral philosopher profoundly shaped by his Jewish background. A pupil of Husserl and Heidegger, Levinas pioneered new forms of exegesis with his post-modern readings of the Talmud, and as an ethicist brought together religious and non-religious, Jewish and non-Jewish traditions of contemporary thought. Color relationalism is the view that colors are constituted in terms of relations between subjects and objects. The most historically important form of color relationalism is the classic dispositionalist view according to which, for example red is the disposition to look red to standard observers in standard conditions (mutatis mutandis for other colors).1 However, it has become increasingly apparent in recent years that a commitment to the relationality of colors bears interest that goes beyond dispositionalism (Cohen, 2004; Matthen, 1999, (...) 2001, 2005; Thompson, 1995). Accordingly, it is an important project for those interested in the metaphysics of color to sort through and assess different forms of color relationalism. There is, however, a powerful and general cluster of objections that has been thought by many to amount to a decisive refutation of any and all forms of color relationalism. Although this idea has been developed in a number of ways, the basic thought is that relationalism — qua theory of color — is at odds with the manifest evidence of color phenomenology, and that this clash between theory and data should be resolved by giving up the theory. Recent years have featured a spate of regulatory action pertaining to the development and/or disclosure of corporate governance structures in response to financial scandals resulting in part from governance failures. During the same period, corporate governance activists and institutional investors increasingly have called for increased voluntary governance disclosure. Despite this attention, there have been relatively few comprehensive studies of governance disclosure practices and response to the regulation. In this study, we examine a sample of 50 U.S. firms and their public (...) disclosure packages from 2004. We find a high degree of variability in the presentation and reporting format choices for many elements of the governance structure. This variability includes several items for which disclosure is mandated by regulators or legislative action. In particular, smaller firms offer fewer disclosures pertaining to independence, board selection procedures, and oversight of management (including whistleblowing procedures). There are also trends associated with board characteristics: boards that are less independent offer fewer disclosures of independence and management oversight matters. Moreover, large firms provide more disclosures of independence standards, board selection procedures, audit committee matters, management control systems, other committee matters, and whistleblowing procedures but do not appear to have a strictly superior information environment when compared to smaller firms. The findings raise questions about compliance with regulatory requirements and the degree to which conflicts of interest between managers and directors are being controlled. While there have been notable improvements in the information environment of governance disclosures, there remain structural issues that may possess negative ramifications for stakeholders. (shrink)

Atomists such as Democritus thought color to be "conventional," not real; Galileo and other key figures of the Scientific Revolution thought that it was an erroneous projection of our own sensations onto external objects. More recently, philosophers have enriched the debate about color by aligning the most advanced color science with the most sophisticated methods of analytical philosophy. This introductory essay is neither intended to be a full presentation nor to be a critical evaluation of the contributions to philosophy made by Eino Kaila. Kaila's work will (...) speak to the reader through the four papers here published in English translation from the German. They belong in the tra dition of the Vienna Circle and of logical empiricism. They cover, however, only one period or sector of Kaila's rich and varied life-work. This is the sector best integrated into the mainstream of contemporary philosophic thinking. The primary aim of this essay is to portray an impressive intellectual personality and to make a modest contribution to Finnish and Scandinavian intellectual history. Much of its content may be thought to be of 'local' relevance only. But considering the position which Kaila held in his country and considering his decisive influence on the development of philosophy in Finland, I hope that this local background will also interest an international circle of readers. Perszyk has argued that Molinists cannot consistently endorse the consequence argument because of a structurally similar argument for the incompatibility of true Molinist counterfactuals of freedom and the ability to do otherwise. Wierenga has argued that on the proper understanding of CCFs, there is a relevant difference between the consequence argument and the anti-Molinist argument. I argue that, even on Wierenga’s understanding of CCFs, there is in fact no relevant difference between the two arguments. In their target article, Rips et al. have presented the view that there is no necessary dependency between natural numbers and internal magnitude. However, they do not give enough weight to neuroimaging and neuropsychological studies. We provide evidence demonstrating that the acquisition of natural numbers depends on magnitude representation and that natural numbers develop from a general magnitude mechanism in the parietal lobes.

Both the Apology and The Trial are such works. Socrates initially seems a model of clarity to the interpreter. He responds to his accusers in a form of direct discourse that can be taken at face value. He presents his arguments openly and cogently. There can be no doubt that his general position is coherent, consistent, and reasonable. Yet the interpreter 's initial satisfaction fades as Socrates' irony creates confusion about what Socrates professes to know. His lines of reasoning seem to intersect in paradox; his answers to questions about the meaning and purpose of human life curve around to miss each other. The interpreter emerges confused and perplexed. These transformations of perspective and significance are repeated in The Trial. Joseph K., too, is described in a straightforward manner that is clear and quite detailed. His reactions and arguments appear sensible and well-reasoned. Yet on closer examination, his simple statements turn out to have hidden meanings; his responses often contradict one another; his logical arguments appear pointless. The same Congress that adopted the 14th Amendment, he notes, passed race-specific laws that extended aid to blacks. Indeed, there are various kinds of affirmative action--compensation for past discrimination, remedial measures aimed at current discrimination, the guarantee of diversity--and Sterba reviews the Supreme Court cases that build a constitutional foundation for each. Affirmative action, he argues, favors qualified minority candidates, not unqualified ones. Both authors offer concluding comment on the University of Michigan cases decided in 2003. Half a century after Brown v. Board of Education, issues pertaining to racial discrimination continue to grip American society. In the present study, I explore the relationship between purpose, which was measured by the Claremont Purpose Scale, and moral psychological indicators, moral reasoning, moral identity, and empathy. Purpose was quantified in terms of three subcomponents: meaning, goal, and beyond-the-self motivation. Moral reasoning was assessed in terms of utilization of postconventional moral reasoning. Moral identity was examined with two subscales: moral internalization, and symbolization. Among diverse subscales of empathy, I focused on empathic concern and perspective taking, which have been reported (...) to be strongly related to morality. To explore the best prediction models using the data, I employed Bayesian Model Selection and Bayesian regression analysis. In general, purpose was significantly predicted by most surveyed moral psychological indicators but not by moral symbolization. The best prediction model for beyond-the-self motivation included the most moral psychological indicator predictors including moral reasoning, which did not significantly predict other dependent variables. In The Wager of Lucien Goldmann, Mitchell Cohen provides the first full-length study of this major figure of postwar French intellectual life and champion of socialist humanism. While many Parisian leftists staunchly upheld Marxism's "scientificity" in the 1950s and 1960s, Lucien Goldmann insisted that Marxism was by then in severe crisis and had to reinvent itself radically if it were to survive. He rejected the traditional Marxist view of the proletariat and contested the structuralist and antihumanist theorizing that infected (...) French left-wing circles in the tumultuous 1960s.
